The Firm

The law firm CLOUTH & PARTNER was established on 1 January 2009 as the Frankfurt based office of a supra-regional law firm focusing on banking and capital markets law. Since 1 July 2012 the firm has been operating under the firm name “CLOUTH & PARTNER Partnerschaft von Rechtsanwälten mbB”.

We are specialized in advising and representing banks, financial institutions and other financial service providers.

Clients in other businesses obtain our advice on contractual and corporate matters.

Our services include the provision of legal advice as well as the representation of our clients in litigation.

Most of our lawyers have previously held leading positions in legal departments of major banks, a private equity company or in international law firms respectively.


Our Expertise

Our practice is focused on banking and capital markets law. We handle all civil law and regulatory matters in these areas with special expertise in capital investments and derivatives as well as in the law on credits and loan collaterals.

Another focus of our practice lies on the investment legislation. We render advice on the structuring, implemention and management of collective investment undertakings, we draft investment funds related documentation, e.g. depositary and service level agreements, and we assist on all civil law and regulatory issues related to marketing.

In addition we advise companies of all legal forms, their bodies and owners on all issues relating to corporate and insolvency law (including compliance and corporate governance) and represent them in litigation. We also advise on transactions.

Our lawyers regularly participate as speakers in seminars and contribute as authors or editors to publications in legal magazines, handbooks and commentaries.
